
Four steps in the Non-Hotel
A guide on non-hotel solutions in the tourism sector and the requirements to be met within the territory of the Apulia Region.

What you need to know if you want to open a
(ref. norm. regional law no. 27 of August 7, 2013 - L.D. 30/4/2019 no.34, art.4)
- 1The activity of "family-run B&B" in Puglia can be carried out in your own home in a non-continuous and non-entrepreneurial way, by submitting the appropriate SCIA (Segnalazione Certificata di Inizio di Attività) at the Suap office of your municipality attaching the relevant documentation required by the Regional Law also regarding the characteristics of the property and the possession of the sanitary and hygienic requirements of the same.
(Ref. norm. regional law no. 27 of August 7, 2013 - 2That you will need to register the facility with the Regional Registry of Facilities established at the Region of Puglia (through the dms.puglia.it, through the SPID system), by applying for the assignment of a "Structure Identification Code" (CIS) as well as at the database being established at the Ministry of Cultural Heritage and Activities and Tourism
- 3That, in localities where the tourist tax is in force, you will have to accredit the facility at the dedicated municipal portal, for the purpose of paying the tax collected from guests according to the regulations in force in the municipality
- 4That you will have to register the facility at the Accommodation Web site of the Police Headquarters territorially responsible for the area in which the facility is located and provide yourself with credentials in order to register each arrival within 24 hours, in compliance with the provisions of TULPS art.109
- 5That you will be able to use up to a maximum of three rooms and nine beds within the property in which you actually permanently reside for the entire period of activity, which may last a minimum of ninety days and a maximum of two hundred and seventy days per year (with the obligation to indicate the period of opening annually at the Suap of the municipality)
- 6That within the structure used as a Family B & B, the Bathroom dedicated to the guest shall be autonomous and distinct from the bathroom room for the use of the host family and shall still be guaranteed the availability of at least one bathroom for every two rooms
- 7That the minimum area of the room shall be equal to or greater than 8 square meters for rooms with one bed, 12 square meters for rooms with two beds, with an increase in area of 4 square meters for each additional bed
- 8That daily cleaning of the premises shall be guaranteed and linen change shall be provided twice a week and at each change of the guest
- 9That breakfast shall be provided within the dwelling, exclusively in one of the shared family spaces.
In the case of serving typical local foods processed directly by the host in the household there will be an obligation to provide guests with information on the ingredients used, with particular reference to food intolerances and allergies.

- 1The accommodation activity of "B&B in entrepreneurial form" is carried out on a continuous and professional basis by sole proprietorships and/or companies registered with the Register of Companies of the competent Chamber of Commerce and can be carried out in the domicile of the owner of the enterprise (or in the domicile of a family member or partner of the owner) in which the accommodation and breakfast service will be provided in no more than six rooms and eighteen beds, including through the cooperation of qualified personnel
- 2That The activity of B&B in entrepreneurial form may be exercised in a single property unit or in two property units located in the same building or in two buildings not more than one hundred meters apart, measured in the shortest possible pedestrian route, equipped with the structural and sanitary characteristics provided for residential use by the municipal regulations in force, in full compliance with the regulatory requirements for construction, urban planning, public safety and the administration of food and beverages
- 3That in order to start the activity of Business B&B in Puglia you will have to submit the appropriate SCIA (Segnalazione Certificata di Inizio di Attività) at the Suap office of the municipality responsible for the area, enclosing the relevant documentation required by the Regional Law also with regard to the characteristics of the property and the possession of the sanitary and hygienic requirements of the same as well as civil liability insurance policy for the occurrence of any damage to guests staying in the structure
- 4That the minimum area of the room shall be equal to or greater than 8 square meters for rooms with one bed, 12 square meters for rooms with two beds, with an increase in area of 4 square meters for each additional bed
- 5That daily cleaning of the premises shall be guaranteed and linen change shall be provided twice a week and at each change of the guest
- 6That the provision of breakfast will have to be provided within the facility, exclusively in a designated space, and that it will be necessary to have all the necessary sanitary authorizations

- 1The receptive activity of "Guesthouses" can be carried out, on a continuous and entrepreneurial basis, by sole proprietorships and/or companies registered with the 'appropriate section of the competent Chamber of Commerce at facilities consisting of no more than six rooms, located in no more than two apartments, furnished, in the same building, in which the accommodation and, possibly, complementary services are provided, such as catering if carried out by the same owner of exercise
- 2That if ever the activity of Guesthouses is carried out in a complementary form to the catering business, the owner thereof is required to register in the special section of the register of business operators provided for in Art. 5 of Law no. 217 of 1983
- 3That the premises intended for the operation of rooming houses must possess the structural and hygienic-building characteristics required, for dwelling houses, by the municipal regulations
- 4That Guesthouses must provide, using normal family organization, the following minimum hospitality services included in the room price - cleaning of the premises at each change of customer and, in any case, at least one once a week; - Change of linen at each customer change and at least once per week; - Supply of electricity, heating, hot and cold water
- 5That guest bedrooms should be accessed without passing through rooms or facilities intended for the family or other guest
- 6That the accommodations used must have the following specific characteristics: - Be equipped with a sanitary facility complete with: toilet, washbasin with running water, hot and cold, bathtub or shower, mirror; - minimum bedroom furniture should consist of: bed, chair or stool per person, closet and waste basket; - where there are more than four beds, the establishment must be equipped with two bathrooms;
- 7That in order to start the activity of Guesthouse in Apulia you will have to submit the appropriate SCIA (Segnalazione Certificata di Inizio di Attività) at the Suap office of your municipality, attaching the relevant documentation required by the Regional Law also with regard to the characteristics of the property and the possession of the sanitary and hygienic requirements of the same
- 8That the facility will have to be registered with the Regional Registry of Facilities established at the Region of Apulia, requesting the assignment of a "Facility Identification Code" (CIS) as well as with the database to be established at the Ministry of Cultural Heritage and Activities and Tourism
- 9That you will have to register the facility at the Accommodation Web site of the Police Headquarters territorially responsible for the area where the facility is located and provide yourself with credentials in order to register each arrival within 24 hours, in compliance with the provisions of TULPS art.109
- 10That, in localities where the tourist tax is in force, you will have to accredit the facility at the dedicated municipal portal, for the purpose of paying the tax collected from guests according to the regulations in force in the municipality

- 1The activity of "Tourist Rental" is carried out on an occasional, non-business basis within the limit of 4 real estate units, by means of letting - in the form of short lease - by natural persons of real estate for residential use for a period not exceeding 30 days, with the possibility of providing services such as providing linen and cleaning the premises
- 2That in the case of several contracts concluded in the year between the same persons, the 30-day time limit should be considered in relation to each individual contract
- 3That the properties to be used for tourist rental shall be exclusively in the cadastral category of units for residential use (cadastral category A 1 to A 11) and may also include properties under sublease, commodate for consideration, and real estate portions of a dwelling
- 4That the short lease agreement, to be properly drawn up in writing, does not require registration
- 5That the exercise of accommodation activities in the form of tourist rental can be exercised on an occasional and non-entrepreneurial basis within the limits of the number of 4 real estate units, exceeded which the exercise of the activity will be considered ex lege (art. 596 L n.178/2020) carried out in an entrepreneurial form with any consequent obligation to register the activity with the competent Chamber of Commerce, with any related legal obligations;
- 6That you will need to register the facility with the Regional Registry of Facilities established at the Region of Puglia (through the dms.puglia.it, through the SPID system), by applying for the assignment of a "Structure Identification Code" (CIS) as well as at the database being established at the Ministry of Cultural Heritage and Activities and Tourism
- 7That you will have to register the facility at the Accommodation Web site of the Police Headquarters territorially responsible for the area where the facility is located and provide yourself with credentials in order to register each arrival within 24 hours, in compliance with the provisions of TULPS art.109

What is there to know if you already have a
Remember that you will have an obligation to comply with the following administrative requirements as well
- 1Report the CIS in all writings, printed matter, digital media used for the purpose of advertising, promotion or marketing of the accommodation offer as well as the establishing identification code to be issued nationwide by the Ministry
- 2Display to the public in the reception room/common areas the copy of the SCIA, the prices applied, the periods of activity, as well as the maximum accommodation capacity
- 3Register the facility with the Accommodation Web site of the relevant police headquarters and then comply with public safety obligations by registering guest identification data within 24 hours of arrival
- 4To provide, in the localities where the tourist tax is in force, for the collection of the tourist tax from the guests, to be paid into the municipal coffers in the time and manner established by the regulations in force in the municipality
- 5Communicate to the PugliaPromozione Regional Agency by October 01 of each year, in compliance with the regulations in force, the minimum and maximum prices applied with regard to the following year and periods of activity (CPS)
- 6Comply with the obligation to report to the regional agency Puglia Promozione the movement of guests for the purpose of statistical survey, according to the methods and terms established by the Region
- 7Display the regional mark referred to in Article 11 on the outside where the same has been issued
- 8Issue to the customer, at the end of each stay, a document that is fiscally valid in relation to the type of business conducted, proving payment for services rendered
- 9Underwrite an appropriate liability insurance policy for the occurrence of any damage to paying guests, limited to the type of B&B operated as an entrepreneurial business and rooming house
- 10Exhibit the registration in the business register, limited to the activity of B&B exercised in entrepreneurial form and room rentals
Remember that you will have an obligation to comply with the following administrative requirements as well

- 3Have the guest sign the short lease contract (recommended) and issue written receipt of payment of the cost of the stay - recommended - (for amounts exceeding €. 77.00 runs the fiscal obligation to affix € 2.00 revenue stamp)
- 4To provide, in the localities where the tourist tax is in force, for the collection of the tourist tax from the guests, to be paid into the municipal coffers in the time and manner established by the regulations in force in the municipality
- 5Comply with the obligation to report to the regional agency Puglia Promozione the movement of guests for the purpose of statistical survey, according to the methods and terms established by the Region
